These Terms of Use ("Terms") govern your access to and use of the WeVite websites, applications, and services (collectively, the "Services"). By accessing or using the Services you agree to be bound by these Terms.

Subject to the terms and conditions of this Agreement, WeVite provides you with a non-exclusive, non-transferable right to access and use the Services during the subscription term for your internal business purposes in accordance with the use restrictions set forth herein and in the Documentation.
This Agreement shall commence when you create an account or first access the Services and shall continue until terminated in accordance with the provisions herein.
Basic Plan: Free for cash-at-the-door events. Includes event creation, attendee management, and basic features.
Essentials Plan: $50/month when selling tickets online. Includes all Basic features plus online payment processing, instant payouts, and sales analytics.
Business Plan: $300/month for advanced features including team collaboration, advanced analytics, custom branding, and priority support.
Launch Discounts: WeVite currently offers launch discounts on all paid plans. Monthly subscriptions receive launch pricing, while yearly subscriptions receive additional savings plus 2 months free.
Promotional Pricing: WeVite may offer promotional pricing, discounts, or special offers from time to time. Such promotions are subject to their own terms and conditions.
Processing Fees: When selling tickets online, Stripe's standard payment processing rates apply (currently 2.9% + $0.30 per transaction). These fees are collected directly by Stripe from each transaction.
No Platform Fees: WeVite does not charge additional per-ticket platform fees or commissions on top of Stripe's processing fees.
Instant Payouts: Funds from ticket sales are transferred directly to your connected Stripe account and are typically available within 1-2 business days.
Billing Cycle: Subscription fees are billed monthly or annually in advance, depending on your selected plan. Payment processing fees are deducted from individual transactions as they occur.
Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
Refund Policy: Subscription fees are generally non-refundable. However, you may cancel your subscription at any time to avoid future charges. Processing fees paid to Stripe are subject to Stripe's refund policies.
Plan Changes: You may upgrade or downgrade your subscription plan at any time. Changes take effect at the next billing cycle, though upgrades may be prorated.
Either party may terminate this Agreement at any time with or without cause. WeVite may immediately suspend or terminate your access if you violate these Terms. Upon termination, your right to access the Services will cease, though you may export your data for a reasonable period as determined by WeVite.
WeVite retains all rights, title, and interest in the Services, including all intellectual property rights. You are granted only the limited rights expressly set forth in these Terms. You may not reverse engineer, decompile, or create derivative works of the Services.
You retain ownership of all data, content, and materials you submit to or create through the Services ("Customer Data"). You grant WeVite a limited license to use Customer Data solely to provide the Services. WeVite may use aggregated, de-identified data for analytics and service improvement.
WeVite's collection and use of personal information is governed by our Privacy Policy. For personal data WeVite processes on your behalf (such as attendee information), WeVite acts as a processor under our Data Processing Addendum.
DISCLAIMER: THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEVITE'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO WEVITE IN THE 12 MONTHS PRECEDING THE CLAIM. WEVITE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
You acknowledge that use of the Services involves the risk of data loss, corruption, or unauthorized access. You are responsible for maintaining appropriate backups of your data. WeVite provides standard security measures but cannot guarantee absolute security.
You agree to indemnify and hold WeVite harmless from claims arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of applicable laws; or (d) your Customer Data or content.
These Terms are written in English. Any translated versions are provided for convenience only. In case of conflicts between versions, the English version shall control.
Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
Dispute Resolution: Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
Severability: If any provision is deemed invalid, the remainder of these Terms shall remain in effect.
Assignment: You may not assign these Terms without WeVite's prior written consent. WeVite may assign these Terms at any time.
Modification: WeVite may update these Terms by posting changes on our website. Continued use constitutes acceptance of updated Terms.
Entire Agreement: These Terms, together with the Privacy Policy and any other referenced policies, constitute the entire agreement between you and WeVite.
